Rule 37
Establishment of Safety and Health Committee
: (1) According to subsection (1) of section 74 of the Act, the employer shall form a safety and health committee with the following coordinators and members in establishments employing twenty or more workers:-
(a) Workers at the managerial level of the employer or the establishment designated by him - Coordinator, (b) not more than three members, including one woman, on behalf of the official trade union in the establishment, (c) three members appointed by the Manager including a health worker appointed by the establishment, (d) Senior workers among the workers who have the responsibility of looking after the security of the establishment.
(2) Notwithstanding anything written in clause (b) of sub-rule (1), the employer may add three workers when forming a safety and health committee in an establishment employing more than three hundred workers.
(3) The official trade union shall be responsible for nominating members under clause (b) of sub-rule (1). In the event that there is no official trade union election, the trade unions or workers in the establishment can choose and nominate members by mutual agreement.
(4) The meeting of the committee as per sub-rule (1) shall be held at least four times a year.
(5) The meeting of the committee will be held at the date, time and place called by the coordinator.
(6) The committee may invite any officer of the establishment, any expert with knowledge of safety and health in the meeting.
(7) The procedure and decision-making process of the meeting of the committee shall be as determined by the committee itself.
